The Structure Bill Friday likely establishes. A digital asset classification framework separating commodities from securities from a new hybrid category, safe harbor provisions for token issuers who register, and a settlement layer recognition standard that lets approved platforms operate as Tier 1 infrastructure. None of that requires Congress.
It requires an SEC chair willing to issue rules and an administration willing to defend them in court when the inevitable challenges come. Trump has both.
I Want You To Think About This Particular Aspect
The reason he looks unbothered is because the Clarity Act failing actually strengthens his hand in three ways simultaneously. Politically, every senator who voted no or obstructed the bill gets a name on a list for the midterms “they voted against market clarity and innovation.”
Legally, agency-issued rules move faster than legislation and can be calibrated precisely by people who understand the technical architecture rather than senators who can’t define a smart contract.
And strategically, the stalling exposed which financial industry lobby groups were working which senators the traditional banking cartels pushing to k--l crypto clarity because a regulated digital asset class threatens their settlement monopoly.
The real play underneath all of this is the settlement layer architecture. A tokenized, asset-backed settlement system needs a regulatory framework to operate legally in US markets. That framework can come from statute (Clarity Act) or from agency rulemaking (SEC Structure Bill). Both achieve the same functional outcome the difference is permanence versus flexibility.

We Can Say That They Never Are:
Here’s what nobody in the financial press understands because they’ve never watched this man operate from the inside. The Clarity Act was always a secondary mechanism. The primary architecture was being built simultaneously through agency rulemaking, executive directives, and private-sector partnerships that don’t require a single Senate vote.
-The legislation was the gold standard.
-The agency rules are the fail-safe.
-The private-sector rails are the insurance policy.
Three layers, same outcome.
The Democrats were handed a bipartisan, industry-backed, common-sense market structure bill on a silver platter. They rejected it. They own that rejection now. And POTUS is about to make them wear it.
The SEC under its current chair doesn’t need the Clarity Act to provide market structure clarity. The Securities Exchange Act of 1934 gives the Commission broad authority to issue interpretive guidance, supplemental policy statements, and rule amendments that functionally achieve the same outcome as statutory legislation.

The difference is permanence a statute requires Congress to repeal, while agency rules require a new administration to rewrite through the Administrative Procedure Act’s notice-and-comment process.
