The D’s are panicking, they cannot lose control over the Fed or worse have the Fed shutdown, which is going to happen. Trump is setting the precedent and he wants the court to make the ruling so there is not question of what authority he has. The Fed is trapped, no inflation, Trump is forcing them into a position that they will not be able to get out of.
