I want to say this before I hang it up tonight.
The 25th Amendment does not necessarily have to go through Congress if it is invoked. The 25th Amendment provides for two different scenarios in which the Vice President can assume the powers and duties of the presidency.
And one of them is voluntary transfer of power. Where the President can send a written declaration to the President pro tempore of the Senate and the Speaker of the House that he is unable to discharge the powers and duties of his office.
In this case, the Vice President will immediately assume the powers and duties of the office as Acting President. Which anchor babies can not do. Which is why this would naturally go to Mike Johnson if push came to shove. So I am not throwing out my own facts about the situation people. Just giving you a heads up if it were to happen.
The President can later send another written declaration stating that no inability exists, and he will resume the powers and duties of his office unless the Vice President and a majority of the Cabinet or a review body approved by Congress object within four days.
