(I believe) Loy mentions the possibility of additional Amicus briefs in support of his planned SCOTUS motion to reconsider 22-380, and asking someone to come on and explain how to do this. I took the amicus brief written by Tom Fairbanks, converted it to Word, deleted some of it and added my own opinions and conclusions, including an additional curative. This took all day and evening yesterday and then at 3 a.m., I woke up and spent a couple more hours. I sent it to Loy and asked for review and comment and whether I should delete much of what Tom Fairbanks had submitted since it would be duplicative and waste the Court’s time. In a few hours I got a reply from Deron Brunson advising me he believed it was too late to submit an Amicus brief and that it had to be submitted by a lawyer. Deron also thanked me for the effort and commented that it contained some good information.
My Amicus brief likely (!!) is overstrong for SCOTUS ears, since I did NOT pull any punches. However I think it may be useful in our group effort, and anyone reading it is free to contact me through Patrick.
